Where asbestos containing materials are known to exist, the law prescribes how it is to be treated and what safety precautions are to be taken however for older buildings where no asbestos audit has been undertaken the body corporate has a duty of care under common law to do so and subject to the building’s age may actually be obliged to do so under Occupational Health and Safety regulations.
